Upper Deck Plans to Continue 'Disney Lorcana' Suit

Upper Deck will continue its lawsuit against Ravensburger in Europe over the design of Disney Lorcana TCG, following the settlement of remaining litigation in the U.S., Upper Deck President Jason Masherah has vowed.

Upper Deck had sued Disney Lorcana publisher Ravensburger and designer Ryan Miller in U.S. federal court, alleging that Disney Lorcana used design elements developed by Miller for Upper Deck TCG Rush of Ikorr Upper Deck and Miller recently settled claims against him via an agreed judgment, following the dismissal of Upper Deck’s claims against Ravensburger (see “Upper Deck Settles“).

“We maintain confidence in the evidence including the recent judgment of liability for breach of contract, violating obligations with Upper Deck to protect the intellectual property related to Rush of Ikorr,” Mashareh said.  “We intend to use the judgment as part of our lawsuit against Ravensburger in Europe, where the law forbids profiting from another’s breach of contract.”

Upper Deck has filed suit against Ravensburger in the Netherlands, an Upper Deck spokesperson told ICv2.
